I have no intention of advocating for Mr. Ghosn, but I still remember what the Japanese then-Minister of justice MORI, Masako told about him at that time and when I heard that I felt a bit for him. According to her, Mr. Ghosn had to prove his innocence to be acquitted. My jaw dropped. She was a Japanese lawyer too and the presumption of innocence is the common concept in all the modern countries' constitutional laws and criminal codes. Then later, when Mr. ABE, Shinzo, the Japanese ex-Prime minister, was investigated for his reportedly criminal activity, she never said the same thing on Mr. ABE. So, to some degree, I must admit that this country's legal system is injustice and weird, as Mr. Ghosn pointed out.

 

This event also showed how the Japanese glass ceiling, or diamond ceiling which was much harder than other western countries, worked oddly.

Under Japanese male-dominated society, the female need to swear allegiance to bosses and organizations no matter how it seems oddly and how far from ethical and professional duties to get promoted or even just to keep a modest income. Even the minister must do the same, as she proved.

 

When excellent people with high morals can get promoted regardless of their gender in other countries for at least these 30 years, gender discriminations in Japan make it impossible and Japan has been overtaken by other countries and in deep stagnation.

Not a few Japanese lawyers rushed to the exit this year, and I am one of them. There were a couple of reasons we did so.

Even if you are a lawyer who will be suffered from this movement, look on the bright side. It is quite good news for everyone, especially when it comes to Japan, I swear.  

 

This year, here in Japan, courts declared their closure for several months insisting this implementation was necessary for preventing covid-19's spread, whereas no other Japanese national authorities, even no municipalities, have done that at that time. When I heard this announcement, my jaw dropped🙀

Even during WW2, the Japanese courts, which were under martial laws, machinegun attacks, and atomic bombs, had never done that. So it might be natural to wonder why courts did not implement the highest level covid-19 prevention system as other Japanese authorities did instead of court closure. No one can logically explain. That is because the Japanese court under this current civilian constitution made illogical judgment this time.

 

I know most of the Western countries prohibit ADR by AI  to a certain degree in terms of restriction against the unauthorized practice of law. In Japan, there is no such alert here. You may presume that it is a way to solve the court shut-down problems by positively installing the legal tech. However, in reality, this is no such positive thing. This issue has not been discussed enough among the Japanese lawyers, and surprisingly, most of the lawyers seem not to notice how crucial influence this technique has on the practice of law.

 

In any way, I wish legal tech will save civil rights in Japan as the alternative to Japanese courts which are regrettably notorious for being arrogant to citizens and lawyers, and alas, which lost their credibility by committing sabotage and wasting taxpayers' money amid the covid-19 crisis among other things. 

 

And what I felt after quitting my job?
